2. What these terms apply to

These terms apply to every quote, order and agreement between ZIG Engineering and the client. Deviations only apply where we have confirmed them in writing.

3. Quotes

A quote is without obligation and valid for thirty days from its date. The information on this website is indicative and does not constitute an offer. An agreement comes into being at the moment the client accepts the quote and ZIG Engineering confirms that acceptance.

4. Work on location

We carry out work at a location designated by the client. The client ensures the vehicle is accessible, the battery is sufficiently charged and that work can be carried out safely. If that prevents us from working, we may reschedule the appointment and charge any costs incurred.

5. The client's obligations

The client warrants that:

  • they own the vehicle or have the owner's permission;
  • the vehicle is technically sound and has no defects relevant to the work;
  • earlier software modifications or changes are reported beforehand;
  • they assess for themselves whether and how to report the modification to their insurer, leasing company or other party involved.

6. Result

We make every effort to achieve the agreed result, but give no guarantee of any specific power or torque figure. What is achievable depends on the vehicle, the engine, the software version, the technical condition, the fuel used and the conditions under which measurements are taken. Figures on this website are indicative.

7. Liability

Our liability is limited to the amount the insurer pays out in the case concerned. If the insurer does not pay out, liability is limited to the amount invoiced for the job. We are not liable for consequential loss, including lost income and downtime, nor for damage arising from defects already present before the work. These limitations do not apply in the event of intent or wilful recklessness on the part of ZIG Engineering.

8. Payment

Payment is due immediately on completion of the work, unless agreed otherwise in writing beforehand. In the event of late payment the client owes statutory interest, and a business client additionally owes extrajudicial collection costs.

9. Right of withdrawal for consumers

For a distance contract or a contract concluded off-premises, a consumer in principle has fourteen days to withdraw. Where the service is performed in full within that period at the consumer's express request, and the consumer acknowledges losing the right of withdrawal in doing so, that right lapses on full performance. This is recorded in writing beforehand.

10. Complaints

Report complaints within a reasonable time of discovery, preferably within fourteen days. We respond substantively within fourteen days.

11. Governing law

Dutch law applies to all agreements. Disputes are submitted to the competent Dutch court. Where the client is a consumer, the jurisdiction granted to them by law applies.
